1. Agreement and Definitions

InnovateMore ("we," "our," or "us") operates Pool Route Monitor, a pool service management platform consisting of an iOS mobile application, an Android mobile application, and a web application (collectively, the "Service").

Throughout these Terms:

• "Account" means the company account created when you sign up, together with all employee accounts created under it.
• "Owner" means the person who creates the Account and is responsible for billing. The Owner has full access to the platform.
• "Employee" means any user added to the Account by the Owner, including Managers, Supervisors, and Technicians.
• "Customer Data" means the customer records, pool details, schedules, service logs, photos, and related information you enter into the Service.
• "Active Pool" means any customer pool that has at least one service scheduled or completed in the current billing month. Inactive or paused customers are not counted.

2. Eligibility and Accounts

Who May Use the Service

The Service is intended for pool service businesses and their staff. You must be at least 18 years old and able to form a binding contract to create an Account. The Service is not directed to children, and we do not knowingly permit anyone under 18 to register.

Roles and Access

Accounts are role-based. Owners and Supervisors may access the web application; the iOS and Android applications are available to Owners, Supervisors, and Employees. Technicians see only the routes and customers assigned to them. The Owner is responsible for assigning appropriate roles and for removing access when an Employee leaves the business.

Account Security

Authentication is handled through Amazon Cognito. You are responsible for keeping login credentials confidential and for all activity that occurs under your Account. Notify us at support@innovatemore.dev promptly if you believe an account has been compromised.

3. Free Trial

New Accounts receive a 15-day free trial of the full platform. A valid payment card is required at signup, but your card is not charged during the trial period.

If you cancel before the trial ends, you will not be charged. If you do not cancel, your subscription begins automatically at the end of the trial and billing proceeds as described in Section 4.

4. Subscription, Fees and Billing

Pricing

The Service is offered on a single plan with usage-based pricing:

All features are included in this plan. There are no tiers, no setup fees, and no per-user or per-technician charges — you may add as many employee accounts as your operation needs. All amounts are in U.S. dollars.

Billing Cycle

After your trial ends, your card is charged for the remaining days of that calendar month, and then on the 1st of each month going forward. Active Pools are counted at billing time, so adding or removing customers adjusts your next invoice automatically.

Payment Methods

We accept Visa, Mastercard, Discover, and American Express credit and debit cards. Recurring auto-pay is required. Most debit cards support recurring billing, but some prepaid cards do not and cannot be used.

Failed Payments

If a payment fails, we may retry the charge and may suspend access to the Service until the outstanding balance is settled. Your Customer Data is retained during a suspension, subject to Section 9.

Price Changes

We may change pricing. If we do, we will give you advance notice by email or in-app notification before the change applies to your Account, so you can cancel if you do not wish to continue.

5. Cancellation

There are no contracts and no cancellation fees. You may cancel at any time from the billing page in the web dashboard. Your Account remains active until the end of the period you have already paid for, after which it will not renew.

Except where required by law, payments already made are non-refundable. Cancelling stops future charges; it does not refund the current period.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable regulation;
• Upload content you do not have the right to upload, or that infringes another party's rights;
• Attempt to gain unauthorised access to the Service, other accounts, or our infrastructure;
• Interfere with, disrupt, overload, or probe the Service or its security features;
• Reverse engineer, decompile, or attempt to extract the source code of the applications;
• Resell, sublicense, or otherwise commercially redistribute access to the Service without our written permission;
• Use automated means to scrape or extract data from the Service beyond the export features we provide.

We may suspend or terminate an Account that violates these rules, with notice where reasonably practicable.

7. Your Data and Your Responsibilities

Ownership

You retain ownership of your Customer Data. You grant us a limited licence to host, process, transmit, back up, and display that data solely to operate and support the Service for you.

Your Responsibilities

The Service stores information about your customers, including names, addresses, contact details, GPS coordinates of properties, gate codes and other property access information, and photographs of customer properties and work performed. You are responsible for:

• Having a lawful basis to collect and store that information;
• Obtaining any consents your customers or employees are entitled to;
• Ensuring the accuracy of the records you enter;
• Controlling which of your Employees can access which records, through role assignment.

Exports

You may export service logs and records as PDF or Excel files at any time. Once exported, those files are under your control and outside the Service.

Privacy

Our handling of personal information is described in our Privacy Policy, which forms part of these Terms.

8. Our Intellectual Property

The Service — including the applications, interfaces, designs, and the Pool Route Monitor name and logo — is owned by InnovateMore and protected by intellectual property law. Subject to these Terms and your payment of applicable fees, we grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for your business. Nothing in these Terms transfers ownership of the Service to you.

9. Suspension, Termination and Data Retention

You may stop using the Service at any time. We may suspend or terminate your Account for non-payment, for breach of these Terms, or if required by law.

Following termination, we retain Customer Data for a limited period so you can reactivate or request an export, after which it may be permanently deleted. You may request deletion of your data at any time by contacting support@innovatemore.dev. Retention and deletion are described further in our Privacy Policy.

10. Service Availability and Third Parties

The Service is hosted on Amazon Web Services and depends on third-party providers including AWS (hosting and storage), Amazon Cognito (authentication), and Stripe (payments). We work to keep the Service available and reliable, but we do not guarantee uninterrupted or error-free operation, and we may need to perform maintenance or make changes to features.

Mobile applications are distributed through the Apple App Store and Google Play. Your use of those platforms is governed by their own terms.

11. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

Pool Route Monitor is a record-keeping and scheduling tool. It does not provide chemical, safety, regulatory, or professional advice. You remain solely responsible for the pool services you perform, for the accuracy of chemical readings and service records you enter, and for compliance with all laws and standards applicable to your business.

12. Limitation of Liability

To the fullest extent permitted by law, InnovateMore will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost revenue, lost business, or loss or corruption of data, arising out of or relating to your use of the Service.

Our total aggregate liability arising out of or relating to these Terms or the Service will not exceed the amount you paid us for the Service in the twelve (12) months immediately preceding the event giving rise to the claim.

Some jurisdictions do not allow certain limitations of liability, so parts of this section may not apply to you.

13. Indemnification

You agree to indemnify and hold harmless InnovateMore and its officers, employees, and agents from any claims, damages, liabilities, and reasonable legal costs arising out of your Customer Data, your use of the Service, or your breach of these Terms or of any applicable law.

14. Governing Law and Venue

These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-laws rules.

You and InnovateMore agree that any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in San Antonio, Bexar County, Texas, and both parties consent to the personal jurisdiction of those courts.

15. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last Updated" date at the top of this page and, for material changes, notify you via in-app notification or email. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

16. General

• Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and InnovateMore regarding the Service.
• Severability. If any provision is found unenforceable, the remaining provisions stay in full effect.
• No waiver. Our failure to enforce a provision is not a waiver of our right to enforce it later.
• Assignment. You may not assign these Terms without our written consent. We may assign them in connection with a merger, acquisition, or sale of assets.
